eSaaral is a technology marketplace. We provide software that helps customers discover and request local vehicle trips and neighbourhood services, and that helps independent vehicle owners, drivers, and listed providers receive those requests.

Unless we expressly state otherwise in writing, eSaaral does not own, operate, insure, or employ the vehicles, drivers, shops, or property owners shown on the Platform. The transport, hire, repair, or property transaction is primarily between you and the relevant owner, driver, or provider.

“Customer” means a person requesting a trip, hire, directory contact, or enquiry. “Owner” means a person who lists vehicles or related services. “Driver” means a person who accepts driving assignments (including acting-driver requests). “Provider” means a directory or trade listing (auto, load, helper, mechanic, plumber, and similar). “Booking” means an in-Platform request that creates a booking record (car with driver, self-drive, acting driver, and similar flows we enable).

You must be at least 18 years old and able to form a binding contract under Indian law. You must provide accurate name, email, mobile number, and other details we request.

Login may use Google Sign-In, mobile OTP, or other methods we enable. You are responsible for activity under your account and for keeping OTPs and devices secure. Do not share accounts.

Roles (visitor / customer, owner, driver) have different permissions. Admin and manager staff use a separate admin application and must follow internal operational policies. We may suspend or terminate accounts that provide false information, abuse the Platform, or violate law or these Terms.

Depending on availability in your area, the Platform may include:

(a) Car bookings with driver — trip requests such as round trip, hourly hire, and airport pickup / drop, with fare estimates shown before you confirm;

(b) Self-drive — vehicle hire requests where you (or your authorised driver) drive, subject to licence and document checks the owner may require;

(c) Acting driver — requests for a driver to operate your vehicle for a period or trip, often fulfilled by the first eligible driver who claims the offer;

(d) Contact directories — local auto, load share, helpers, and trade services (for example plumber, electrician, AC / car / bike mechanic, puncture / vulcanizing) where you call or message the listed number;

(e) Real estate listings — property discovery and enquiry / lead flows where owner contact may be revealed only after an enquiry step;

(f) Related features — account profile, trip history, owner fleet tools, document uploads, share links, and support.

We may add, change, or discontinue features. Marketing pages (for example tours or hotel assistance) describe optional help; they are not a guarantee of availability unless a live booking or confirmation is issued.

When you submit a car booking, you ask the Platform to match or assign an available owner / vehicle / driver according to our operational rules. A quote is an estimate based on the trip type, distance model, hours (for hourly), vehicle category, and published rates at that time.

Final payable amounts may include waiting charges, night charges, tolls, parking, interstate taxes, extra kilometres, or other extras agreed at booking or with the operator. You must provide a reachable pickup point, correct passenger count, and luggage needs. You must behave respectfully toward drivers and not ask them to break traffic or other laws.

Self-drive bookings are subject to the owner’s vehicle condition, insurance, deposit, fuel, kilometre, and timing rules communicated at booking or handover. You must hold a valid driving licence (and any other documents required by law or the owner) for the vehicle class.

You are responsible for the vehicle while it is in your custody, including traffic fines, damage beyond normal wear, and fuel unless otherwise agreed. Return the vehicle at the agreed place and time. Disputes about deposits or damage should first be raised with the owner and, if needed, with support@esaaral.com.

Acting-driver requests ask a licensed driver to operate a vehicle you provide or arrange. You must ensure the vehicle is roadworthy, legally permitted for the journey, and insured as required. The driver must follow traffic law; you must not instruct illegal or unsafe driving.

Offers may be claimed by eligible drivers on a first-accept basis. Until a claim / assignment is confirmed, availability is not guaranteed. Payment terms follow what is shown in the flow or agreed with the driver / ops team.

All prices are shown in Indian Rupees (INR) unless stated otherwise. Estimates may change if inputs change (route, hours, vehicle, waiting). Payment may be cash to the operator, pay-later, or other methods we display.

Coupons and offers apply only when valid for that service, vehicle, and time window, and may be withdrawn for misuse. Unless we collect money as a disclosed platform fee, amounts paid to owners or drivers are not fees paid “to eSaaral” for liability-cap purposes.

You may request cancellation or changes in the app / website or via support. Whether a cancellation is free, charged, or refundable depends on booking status, timing, and operator / platform policy at that moment.

Owners and drivers must honour confirmed assignments except for safety reasons, vehicle failure, medical emergency, or other legitimate reasons communicated promptly. Repeated no-shows or last-minute cancellations by any party may lead to warnings, fees where disclosed, or account limits.

Local auto, load share, helper, and trade directories are primarily contact directories unless an in-app booking button is clearly offered. Calling or messaging a listed number creates a direct arrangement between you and that provider.

eSaaral does not guarantee response time, price, quality, or completion of directory jobs. Do not scrape, harvest, spam, or resell directory contacts. Report wrong numbers or misuse to support.

Property information (price, size, photos, location description) is supplied by listers or our desk team based on information they provide. Listings may hide owner mobile until an enquiry or lead step.

eSaaral is not your broker of record, lawyer, or valuer unless we state that in a separate written engagement. Independently verify title, approvals, measurements, and payments before any advance or agreement. Do not use the Platform for fraudulent leads or harassment of owners.

Owners must keep registration, insurance, permits, photos, pricing, and availability accurate, and upload documents we request for verification (KYC). Drivers must hold a valid licence for the vehicle class, follow motor vehicle and traffic law, and treat customers courteously.

False documents, unsafe vehicles, duplicate spam listings, or harassment may result in suspension and, where required, reports to authorities. Owners are responsible for legal compliance of their fleet and for payouts / taxes applicable to their earnings.

You may not: interfere with or overload the Platform; attempt unauthorised access; scrape beyond ordinary browsing; upload malware; post illegal, defamatory, or infringing content; impersonate others; or use the Platform for trafficking, weapons, or other unlawful carriage.

We may remove content, refuse or cancel bookings, block numbers, or suspend accounts to protect users and the Platform.

The eSaaral name, logos, software, and site design are owned by us or our licensors. You receive a limited, revocable licence to use the Platform for its intended purpose. You may not copy, reverse engineer, or exploit our software except as allowed by law.

You grant us a non-exclusive licence to host and display content you upload (photos, listing text, documents) as needed to operate the Platform.

The Platform is provided on an “as is” and “as available” basis. We do not warrant uninterrupted access, error-free maps or fare estimates, or that every listed provider is available when you call.

Vehicle condition, driver conduct, trip safety, repair quality, and property representations are primarily the responsibility of the relevant owner, driver, or provider. Always use your own judgment for safety and legal compliance.

To the fullest extent permitted by Indian law (including mandatory consumer protections that cannot be waived), eSaaral is not liable for indirect, incidental, special, or consequential losses, or for loss of profits, data, or goodwill, arising from trips, directory contacts, real-estate enquiries, or Platform downtime.

Our aggregate liability for claims relating to a specific Platform transaction is limited to the fees (if any) you paid directly to eSaaral for that transaction. Nothing in these Terms excludes liability for fraud or other liability that cannot legally be limited.

You agree to indemnify and hold harmless eSaaral and its operators from claims, losses, and reasonable costs arising from your misuse of the Platform, your breach of these Terms, or your violation of law or third-party rights — except to the extent caused by our wilful misconduct.

We are not liable for delays or failures caused by events beyond reasonable control, including natural disasters, strikes, network outages, government actions, epidemics, or severe weather affecting roads.

These Terms are governed by the laws of India. Courts in Tamil Nadu shall have exclusive jurisdiction, subject to mandatory consumer rights that apply to you.

Please contact support@esaaral.com first so we can try to resolve the issue. You may also use applicable consumer forums or other remedies available under Indian law.

We may update these Terms from time to time. The “Last updated” date will change when we publish a revision. Material changes may also be highlighted on the Platform. Continued use after publication constitutes acceptance of the updated Terms.
